Welcome to Ufone U-Cloud, a secure and convenient cloud storage and data management platform designed to help you store, manage, and access your digital content with ease.
By registering for or using our services, you agree to these Terms of Service (“Terms”). If you do not agree, you may discontinue use of the service at any time.
1. Acceptance of Terms
By creating an account or using U-Cloud, you confirm that you have read, understood, and agree to these Terms, forming a binding agreement between you (“User”, “you”) and Pakistan Mobile Communications Ltd. (Ufone) (“we”, “our”, “us”).
- If you do not agree to these Terms, you cannot use U-Cloud.
- We may update or modify these Terms periodically to reflect improvements or regulatory requirements. Material updates will be communicated in advance, and continued use of U-Cloud will constitute acceptance of revised Terms.
- Certain features or services may be governed by additional product-specific terms (“Product Terms”). In case of any inconsistency, those Product Terms shall prevail.
2. Account Registration & Eligibility
To access and use U-Cloud, you must register an account. You must:
- Be at least 18 years of age (or the legal age of majority). If you are underage, your parent or guardian must agree to these Terms on your behalf.
- Register as an individual, non-commercial user (not on behalf of a company or entity).
- Provide accurate and complete information during registration and keep it updated.
- Maintain the confidentiality of your login credentials. You are responsible for all activity under your account.
- If you suspect unauthorized access or password misuse, notify us immediately at customercare@switch.com.pk.
We reserve the right to suspend or close your account in case of non-payment for over one (1) month or if verification requirements are not met. Your personal data will be handled per our Privacy Policy, in compliance with Pakistan Telecommunication Authority (PTA) regulations.
3. Use of Service
U-Cloud is provided on an “as is” and “as available” basis. By using the service, you agree to:
- Use U-Cloud solely for personal, lawful, and non-commercial purposes.
- Not resell, share, or redistribute the service or its content.
- Not attempt to replicate, transfer, or decompile the software or its source code.
Ufone may introduce updates or new features from time to time that require user acceptance before continued use.
4. Content Ownership & Usage Rights
You always retain ownership of your uploaded content (“Your Content”). However:
- By uploading or sharing content, you grant Ufone and its authorized service providers a limited, non-exclusive right to process and manage your content for service delivery.
- Ufone may disclose data to lawful authorities or PTA if required under applicable law.
- All Ufone trademarks, logos, and related branding are the sole property of Ufone.
If you believe your intellectual property rights are infringed, please email customercare@switch.com.pk with:
- Identification of the infringing content and its location on U-Cloud.
- Proof of ownership and your contact details.
5. Usage Policy
To ensure a safe and compliant environment, you agree that your use of U-Cloud and Your Content shall not:
- Contain obscene, pornographic, defamatory, or offensive material.
- Impersonate, harass, threaten, or incite harm toward others.
- Encourage unlawful, violent, or discriminatory behavior.
- Infringe intellectual property, confidentiality, or privacy rights.
- Promote drugs, terrorism, or any illegal activity.
- Breach national security or integrity laws of Pakistan.
You further agree not to:
- Interfere with U-Cloud’s operations or security.
- Attempt to hack, inject malware, or gain unauthorized access.
- Collect or harvest data from users or systems.
- Use U-Cloud for spamming, phishing, or bulk marketing activity.
Non-compliance may result in suspension or termination of your account, legal action, and potential damages or indemnities as permitted by law.
6. Feedback
We value your feedback and suggestions to enhance U-Cloud. By sharing feedback, you agree that:
- It is provided voluntarily and on a non-confidential basis.
- Ufone and its partners may freely use, modify, and incorporate feedback into services without obligation or compensation.
7. Termination & Suspension
You may terminate your account at any time through the app or by notifying us at customercare@switch.com.pk.
Ufone may terminate or suspend your account immediately if:
- You violate any of these Terms.
- Ufone ceases to offer the U-Cloud service.
- There are legal, security, or operational reasons requiring suspension.
Upon termination:
- You will lose access to your data stored on U-Cloud.
- You must delete the U-Cloud application from your device.
8. Disclaimer of Warranties
U-Cloud is provided on an “as is” and “as available” basis. While Ufone strives for reliable service, we do not guarantee uninterrupted or error-free operation.
Ufone disclaims all warranties, express or implied, including those of merchantability, fitness for purpose, and non-infringement. If you are dissatisfied with U-Cloud’s performance, you may cancel your account per Section 7.
9. Limitation of Liability
- Ufone shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use U-Cloud.
- The total aggregate liability of Ufone and its partners for any claim shall not exceed USD 100.
- Ufone is not responsible for any damages to your software, device, data, or third-party content accessed through U-Cloud.
10. Copyright & Complaints
For copyright-related complaints or suspected infringements, please contact customercare@switch.com.pk.
Include the following details:
- Description of the copyrighted material.
- Location or URL of the infringing content.
- Your name, contact number, and email address.
Ufone will review all valid claims in accordance with applicable intellectual property laws.
11. General Terms
- Ufone reserves the right to discontinue all or part of U-Cloud at any time.
- Notices may be sent via email, SMS, or in-app notification.
- Ufone may transfer its rights and obligations under these Terms to another entity; users will be notified accordingly.
- Each clause of this Agreement operates independently — if any part is deemed unlawful, the rest remains in force.
- Failure to enforce any clause does not constitute a waiver of rights.
- Ufone is not responsible for service interruptions caused by factors beyond its control, such as network issues, system maintenance, or force majeure events.
12. Dispute Resolution
We aim to resolve any issues promptly and fairly. If you experience any concerns, please reach out to our support team first. Disputes that cannot be resolved amicably may be referred to arbitration or the courts of competent jurisdiction within the Islamic Republic of Pakistan.
